Terms and Conditions Blissful Healing & Coaching

  1. Definitions

    1. Client: natural person or legal entity who gives an assignment to Blissful Healing & Coaching

    2. Participant: a natural person who uses services offered by Blissful Healing & Coaching, including personal coaching sessions and/or trajectory, workshop and energetic healing sessions and participation in retreats

    3. Company Retreats: retreats aimed at participants belonging to one company or agency

    4. Start: the time at which the agreed service/activity starts.
       

  2. Application

    1. These General Terms and Conditions apply to all agreements offered via www.blissfulhealing.nl to which Blissful Healing & Coaching is a party.

    2. When registering for a personal coaching session, workshop, retreat and/or energetic healing sessions, the Client and/or Participant declare that they are aware of the applicability and content of these General Terms and Conditions in writing.

    3. If a third party concludes the agreement with Blissful Healing & Coaching on behalf of the Client and/or Participant, this third party guarantees that the Client and/or Participant knows and has accepted these conditions, failing which the third party is bound by these conditions as if they were he himself is a Client or Participant
       

  3. Confidentiality

    1. The parties acknowledge that the content of the relationship as well as the data and information that is/become known to them in the context of the agreement and the execution of the agreement are of a strictly confidential nature.

    2. None of the Parties will directly or indirectly disclose the content of the relationship as well as the data and information that it becomes aware of to third parties.

    3. The obligations referred to in 3.1 and 3.2 apply both during the term of an agreement and after its expiry.
       

  4. Establishment of the agreement between Client and/or Participant and Blissful Healing & Coaching

    1. The agreement between the Client and/or Participant and Blissful Healing & Coaching is concluded when the quotation signed for approval by the Client has reached Blissful Healing & Coaching or when the Client and/or Participant has registered online, unless the Parties agree otherwise.

    2. A registration for a workshop, session, retreat or coaching is only final when the participation costs have been credited to the Contractor's bank account.

    3. The participant has the right to terminate the agreement without giving reasons within 14 days after concluding the agreement.
       

  5. Cancellation by Client and/or Participant
    If the Client and/or Participant cancels or changes the agreed date for personal coaching, retreat or other service, the following applies:

    1. In case of cancellation up to thirty days before commencement:
      The Client and/or Participant owes 50% of the invoice amount according to the quotation to Blissful Healing & Coaching and will receive an invoice for this.

    2. In case of cancellation thirty to fourteen days before Commencement:
      The Client and/or Participant owes 75% of the invoice amount according to the quotation to Blissful Healing & Coaching and will receive an invoice for this.

    3. In case of cancellation from fourteen to seven days before Commencement:
      The Client and/or Participant owes 90% of the invoice amount according to the quotation to Blissful Healing & Coaching and will receive an invoice for this.

    4. In case of cancellation within seven days before Commencement:
      The Client and/or Participant owes the entire invoice amount according to the quotation to Blissful Healing & Coaching and will receive an invoice for this.

    5. The foregoing applies without prejudice to the right to further compensation if there are grounds for doing so.

    6. If shifting or canceling a service for Blissful Healing & Coaching entails costs to third parties, Blissful Healing & Coaching is entitled to charge these to the Client and/or Participant.

    7. If a participant does not appear at the start of the service, is only able to attend part of the service or discontinues his participation in the meantime, there is no right to offset this against the invoice amount.

    8. If the Client and/or Participant terminates the performance of the Parties' agreement prematurely, there is no right to offset this against the invoice amount unless there are special grounds for such crediting.
       

  6. Cancellation by Blissful Healing & Coaching

    1. Blissful Healing & Coaching can cancel a service in the event of force majeure and illness of the coach or co-facilitator if no equivalent replacement can reasonably be found. In this case of cancellation, the Client and/or Participant will no longer have any obligation to pay.

    2. Blissful Healing & Coaching may cancel workshops and retreats if the minimum number of participants has not been met.

    3. Blissful Healing & Coaching is entitled to terminate the agreement with the Client and/or Participant prematurely at any time without a notice period if, repeatedly and despite a warning, the Client and/or Participant violates the house rules set by Blissful Healing & Coaching, or otherwise behaves in such a way that Blissful Healing & Coaching cannot reasonably be expected to continue the agreement.

    4. Interim termination as referred to here does not release the Client and/or Participant from their agreed financial obligations.
       

  7. Execution of the assignment

    1. Unless otherwise agreed between the parties, Blissful Healing & Coaching is authorized to engage third parties in the execution of the agreement.

    2. The Client and/or Participant is only obliged to make payment in this regard if this is stated in the quotation or agreed upon by further agreement between the parties.

    3. Blissful Healing & Coaching guarantees the competence of these third parties as assistants engaged by Blissful Healing & Coaching.
       

  8. Invoicing and payment

    1. The invoice amount due according to the quotation signed for approval must be paid to Blissful Healing & Coaching no later than two weeks before the Commencement.

    2. For agreements concluded within the payment term stated above, the invoice amount must be paid immediately.

    3. If the invoice is not paid within the period referred to below, Blissful Healing & Coaching is not obliged to fulfill the obligations referred to in the agreement.

    4. Unless otherwise agreed, the invoice price includes the costs of accommodation, training materials, refreshments and meals.

    5. Travel and transfer costs are not included in the invoice price, unless otherwise stated in the quotation.

    6. Payment of the invoice amount can be made by means of transfer to Blissful Healing & Coaching or by means of a payment request.
       

  9. Liability

    1. Participation in Blissful Healing & Coaching activities is at your own risk.

    2. Blissful Healing & Coaching's liability does not extend beyond the invoice amount paid by the Client and/or Participant.

    3. Blissful Healing & Coaching is not liable for damage that could not be insured under the usual conditions for the industry.

    4. Blissful Healing & Coaching is not liable for damage to or caused by goods brought along by Participants, including equipment, software files, media tools, modest samples and vehicles, unless the damage is the direct result of intent or gross negligence on the part of Blissful Healing & Coaching.

    5. Blissful Healing & Coaching is not liable for damage directly or indirectly to anyone or anything arising as a direct or indirect result of any defect, any quality of or circumstance in an immovable property available to Blissful Healing & Coaching.

    6. Opdrachtgever en/of Deelnemer vrijwaart Blissful Healing & Coaching voor aanspraken van derden, waaronder Deelnemers, ter zake van schade als in deze bepaling bedoeld.

    7. Liability for damage caused by force majeure and/or cancellation by Blissful Healing & Coaching is excluded.
       

  10. Training Materials/Intellectual Property Rights

    1. All text and image materials produced and/or made available by Blissful Healing & Coaching, such as but not limited to training materials, film recordings, photography, brochures, (manual) books, e-books, podcasts, presentations and publications, are and remain independent of the nature of these matters, intellectual property of Blissful Healing & Coaching

    2. Without the express prior written permission of Blissful Healing & Coaching, the Client and/or Participant and/or Teacher is not permitted to publish these materials or parts of these materials or to multiply and/or distribute them in any way.

    3. It is not permitted to use these materials or parts of these materials for educational purposes without the express prior written permission of Blissful Healing & Coaching.

    4. The intellectual property rights to quotations and proposals, etc., arising from the work of Blissful Healing & Coaching rest exclusively with Blissful Healing & Coaching.

    5. In the event of violation of this obligation, the Client and/or Participant will compensate the damage suffered by Blissful Healing & Coaching in the broadest sense of the word - which does not exclude non-material damage.

    6. Media publications about the content of the agreement and the training and media publications using the items referred to in 10.1 are only permitted after prior written permission from Blissful Healing & Coaching.
       

  11. Complaints

    1. Complaints will be made known in writing to Blissful Healing & Coaching within 8 days.

    2. Complaints about the execution of the agreement must be submitted fully and clearly described to Blissful Healing & Coaching within a reasonable time, after the Client and/or Participant has discovered the defects.

    3. Complaints submitted to Blissful Healing & Coaching will be registered, answered within a period of 14 days from the date of receipt and will be treated confidentially by both parties. Complaints are kept for 2 years in a secure digital environment. If a complaint requires a foreseeably longer processing time, Blissful Healing & Coaching will respond within 14 days with an acknowledgment of receipt and an indication when the Client and/or Participant can expect a more detailed answer.

    4. Blissful Healing & Coaching will inform the complainant in writing and with reasons of the findings of the investigation into the complaint, as well as any conclusions it draws from it. If the complainant feels that insufficient justice has been done due to the handling or settlement of the complaint, he or she may appeal to an independent third party. The notification mentions the possibility of submitting a complaint to the National Ombudsman.

    5. The provisions of 11.4 also apply to the person against whose conduct the complaint is directed.

    6. The decision of the appeal body is binding for Blissful Healing & Coaching; any consequences will be handled by Blissful Healing & Coaching within a reasonable period.

    7. If the complaint cannot be resolved with the above, a dispute arises that is subject to the dispute settlement procedure. Blissful Healing & Coaching (CAT therapist) is subject to GAT-Wkkgz complaints law and GAT disciplinary law at the Alternative Therapists Disputes Body (GAT).

    8. In principle, Blissful Healing & Coaching assumes that a suitable solution for the complaint will be found through proper consultation.
       

  12. Disputes

    1. Dutch law applies to every agreement between the Client and/or Participant and Blissful Healing & Coaching to which these general terms and conditions apply.

    2. The judge of the place of business of Blissful Healing & Coaching will be competent to assess and adjudicate all disputes arising from the agreements concluded between the Client and/or Participant and Blissful Healing & Coaching, including the sole collection of the amount owed.

    3. In principle, Blissful Healing & Coaching assumes that a suitable solution for the complaint will be found through proper consultation.
       

  13. Communication

    1. Communication and contact with Blissful Healing & Coaching regarding general matters, administrative matters or services can be done by telephone, e-mail or in writing.

    2. Blissful Healing & Coaching strives to respond to voicemail and email within two business days. Letters will be answered within a maximum of one week.

    3. For written questions that require more time to be answered correctly, the response time may be longer. In this case, a receipt will be sent within one week stating a deadline within which a response can be expected.
       

  14. Disclaimer
